The U.S. Supreme Court on Jan. 13, 2022, blocked the Biden Administration from enforcing a “vaccine or testing” mandate for all employers with at least one hundred employees. Technically the Court’s decision temporarily stays the rule pending the outcome of a decision on the merits by the Sixth Circuit and any subsequent petition for review of that decision to the Supreme Court. As a practical matter, the Court’s opinion makes clear that the Court’s majority does not believe OSHA has the authority to issue the vaccine mandate. But it is hard to see a path forward where OSHA gets this rule reinstated.

A federal appeals court on Nov. 12 kept in place its “stay” against Occupational Safety and Health Administration (OSHA鈥檚) mandate that all large employers require their workers to get vaccinated or submit to weekly testing starting in January. But it’s not the final word on the matter.

黑料社区sent a letter on Sept. 27 to the U.S. Department of Labor鈥檚 Occupational Safety and Health Administration (OSHA) detailing the questions and concerns 黑料社区members have raised in response to President Biden鈥檚 executive order directing businesses with more than 100 employees to require employees to be vaccinated against COVID-19 or produce a negative COVID-19 test weekly. The agency is expected to issue the directive in the coming weeks.
