JUUL Granted Emergency Stay of FDA’s Marketing Denial Order
The U.S. Court of Appeals for the D.C. Circuit on June 24 granted JUUL Labs Inc. an emergency administrative stay of the U.S. Food and Drug Administration's (FDA’s) marketing denial order (MDO) of all JUUL products. Retailers can continue to sell JUUL products while the company challenges the FDA’s MDO.
FDA on June 23 issued an MDO to JUUL Labs Inc. for their products, including the JUUL device and four types of JUUL pods on the market. On June 24, JUUL Labs Inc. requested emergency interim relief from the U.S. Court of Appeals for the D.C. Circuit, arguing FDA’s MDO is arbitrary and capricious. In granting the emergency administrative stay, the court indicated JUUL Labs Inc. has until Monday to file its emergency motion in response to FDA's actions.
Retailers should continue to contact JUUL Labs Inc. with specific questions about products in their inventory.
