Menu-Labeling Requirements Delayed Until May 2018

The Food and Drug Administration (FDA) on May 1 announced that it will delay the compliance date for federal menu-labeling requirements until May 7, 2018.  Restaurants and food retailers were going to have to comply by May 5, 2017.
 
Under the menu labeling rules, chain restaurants and “similar retail food establishments,” including may convenience stores operated by truckstop owners and operators — are required to post calories for prepared food items that are sold in the establishments. The rules require these entities to post calories either on menus or menu boards or, for self-service items and foods on display, on signs that are next to the items.  
 
ºÚÁÏÉçÇøhas been advocating for reforms to the menu-labeling requirements to provide non-traditional sit-down restaurants (e.g., convenience stores, restaurants with self-serve buffets, etc.) more flexibility in how they come into compliance with the rules.  The FDA’s one-year delay is designed to enable the new Administration to examine the requirements and determine if changes are necessary. ºÚÁÏÉçÇøwill be filing comments with FDA on these issues.

ºÚÁÏÉçÇøalso will continue advocating in Congress for the Common Sense Nutrition Disclosure Act, which would provide the flexibility the travel plaza industry needs.
