The American Petroleum Institute (API) has filed a lawsuit with the D.C. Circuit Court challenging the Environmental Protection Agency鈥檚 (EPA) Renewable Fuel Standard (RFS) volume requirements for 2013, arguing that EPA has mandated significantly more cellulosic ethanol than is available in the marketplace.

Echoing legislation introduced in the U.S. House of Representatives earlier this year, U.S. Senators John Barrasso (R-Wyo.), Mark Pryor (D-Ark.) and Pat Toomey (R-Pa.) last week introduced 鈥淭he Renewable Fuel Standard Repeal Act鈥 (S. 1195), which would repeal the Renewable Fuel Standard (RFS) in its entirety. Sen. Barrasso said the RFS is “fundamentally broken and beyond repair,” and that it has driven up food and fuel costs rather than deliver meaningful environmental benefits.

U.S. Senators Roger Wicker (R-M.S.) and David Vitter (R-La.) have introduced legislation to block an increase in the amount of ethanol that can be blended with gasoline. The bill would overturn Environmental Protection Agency (EPA) waivers that allowed gasoline containing 15 percent ethanol (E15) to be used for many passenger cars and light trucks, and would prohibit the agency from granting future waivers for any blends above 10 percent ethanol.
