Recent intelligence indicates that the Environmental Protection Agency (EPA) is likely to propose the Renewable Fuel Standard (RFS) blending mandates/renewable volume obligations (RVOs) for 2021 and 2022 within the next several weeks. Indications are that EPA will set the 2021 RVOs at “actual production,” while the 2022 RVOs will be set at more ambitious levels designed to incentivize increased production and consumption of biofuels.

07-08-2019 by NATSO EPA Proposes Renewable Volume Obligations for 2020

The Environmental Protection Agency (EPA) on July 5 proposed renewable volume obligations (RVOs) for 2020 under the Renewable Fuel Standard (RFS). EPA also proposed RVOs for biomass-based diesel (BBD) for 2021. In the rule, EPA said it would use its waiver authority to lower the volumes of cellulosic biofuels, advanced biofuels, and total renewable fuels below the statutory targets.

The Environmental Protection Agency (EPA) said it will require 19.92 billion gallons of biofuel to be blended into the nation’s fuel system under its 2019 Renewable Fuel Standard (RFS). But in issuing the numbers, the agency failed to address NATSO’s concerns about its practice of issuing small refinery waivers that exempt small refineries from their obligations under the RFS — even small refineries that are owned by profitable refining entities such as Andeavor.

For more than a decade, the federal Renewable Fuel Standard (RFS) program has sought to improve the emissions characteristics of fuel and support the domestic biofuels sector, while increasing American energy independence and security. The program calls for increasing volumes of renewable fuels—known as renewable volume obligations (RVOs)—to be blended into the nation’s transportation fuel supply every year.

ºÚÁÏÉçÇøon Oct. 19 filed comments with the Environmental Protection Agency (EPA) in response to the agency’s request for input on reducing renewable fuel mandates. Specifically, EPA has suggested that it is considering reducing annual renewable volume obligations (RVOs) by tying them to domestic renewable fuel production capacity, rather than the market’s ability to consume renewable fuel. NATSO, in its comments, told EPA that this policy shift would undercut the purpose of the RFS and ultimately lead to higher fuel prices for consumers.
