The U.S. Supreme Court on Jan. 13, 2022, blocked the Biden Administration from enforcing a “vaccine or testing” mandate for all employers with at least one hundred employees. Technically the Court’s decision temporarily stays the rule pending the outcome of a decision on the merits by the Sixth Circuit and any subsequent petition for review of that decision to the Supreme Court. As a practical matter, the Court’s opinion makes clear that the Court’s majority does not believe OSHA has the authority to issue the vaccine mandate. But it is hard to see a path forward where OSHA gets this rule reinstated.

The U.S. Supreme Court on June 25 handed down a decision in the case of Ohio v. American Express, ruling that American Express did not violate the Sherman Antitrust Act. The decision comes after a long battle that started in 2010 when the U.S. Department of Justice (DOJ), in conjunction with several state attorneys general, brought the case against Visa, Mastercard and American Express arguing that the rules promulgated by the card networks preventing merchants from offering discounts were a violation of antitrust laws.

The U.S. Court of Appeals for the Fourth Circuit became the second appellate court to strike down the National Labor Relations Board’s (NLRB) August 2011 regulation requiring businesses to post notices of an employee’s right to unionize, finding that the NLRB exceeded its authority when it ordered businesses to display an 11-by-17-inch notice in a prominent location explaining the rights of workers to join a union and bargain collectively.
