The Food and Drug Administration (FDA) released a website to help retailers comply with the new federal minimum age to purchase tobacco products. Tobacco retailers should use this website as a resource for compliance materials as they are made available.

The Food and Drug Administration on Jan. 15 issued a statement clarifying for retailers that as of Dec. 20, 2019, it is illegal to sell tobacco products to anyone under the age of 21.

The end of year appropriations legislation signed by President Trump on Dec. 20 that renewed the biodiesel tax credit also raised the federal minimum purchase age for all tobacco products from 18 to 21. Although the law wasn’t expected to take effect until several months into 2020, the U.S. Food and Drug Administration (FDA) posted a notice on Dec. 26 stating that the law is in immediate effect. Retailers cannot sell any tobacco products to customers younger than age 21.
