Businesses that own or operate an underground storage tank (UST) system in a state whose UST program does not have “state program approval” status from the Environmental Protection Agency (EPA) are subject to enhanced requirements as of April 12, 2016.

ºÚÁÏÉçÇømembers are reminded that the Environmental Protection Agency’s (EPA) Underground Storage Tank Rule went into effect Oct. 13. This deadline is significant for 12 states – Alaska, Arizona, California, Florida, Illinois, Kentucky, Michigan, New Jersey, New York, Ohio, Wisconsin and Wyoming – and the territories of Guam, Samoa and the North Mariana Islands — which do not have EPA-approved state UST programs. In these states and territories, tank owners are now subject to the EPA’s updated UST regulations, as well as applicable state requirements.

House Small Business Committee Chairman Sam Graves (R-Mo.) has asked the Environmental Protection Agency (EPA) to withdraw its proposed rule on underground storage tanks (UST) arguing that due to methodological flaws the agency has inappropriately certified the proposed rule as not having a significant economic impact on a substantial number of small entities.
